PsyStar Retaliates Apple with an Antitrust Lawsuit
PsyStar is fighting back against Apple as it plans on filing an antitrust lawsuit against Apple after the Mac giant filed suit against PsyStar for selling affordable Mac clones.
Apple filed suit against PsyStar in July, accusing the company of copyright infringement, breach of contract, trademark infringement, trade dress infringement, and unfair competition. As expected, upstart PsyStar responded to Apple's copyright infringement suit with a counterclaim of its own filed in U.S. District Court for the Northern District of California. PsyStar's counterclaim charges Apple with restraint of trade, unfair competition and other violations of antitrust law.
Contrary to Apple's claim of copyright infringement, PsyStar's counterclaim notes that each of its OpenComputer systems ship with a legitimately purchased retail copy of Mac OS X. Apple doesn't license its OS to run on other computers, but PsyStar said it uses open source-licensed code, including code licensed under Apple's own public source license, to allow its computers to run the MAC OS.
For several months, PsyStar has sold systems pre-installed with Apple's OS X operating system. The company uses open source tools to allow the MacOS to run on PC hardware. PsyStar touts its products as a cheaper alternative, which fills voids in Apple's product line, such as consumer tower models.
Other small computer makers that have tried selling Apple Mac clones have fallen at the sword of the Apple team of attorneys. One such company called Open Tech was open for about a month before it put up a for sale sign on its website at http://www.freewebs.com/iopentech/.
